Terms of Purchase

The terms and conditions of business and use of the CSW website and the conclusion of distance contracts via means of remote communication are primarily subject to the Terms of Purchase stated here, unless the contracting parties (Seller and Buyer) agree otherwise.

Terms of purchase are subject to the Consumer Protection Act (OG 41/14) and the Obligations Act (OG 35/05 and OG 41/08).

Prices

The prices of products and services displayed on Internet sites, advertisements and in catalogs are expressed in EUR and include VAT. Product prices do not include delivery costs, unless otherwise stated for the goods themselves, or if the purchase amount does not exceed 50 EUR. Prices, payment terms and special offers are valid only at the time of ordering and / or payment and are subject to change without notice.

Terms of purchase are subject to the Consumer Protection Act (OG 41/14) and the Obligations Act (OG 35/05 and OG 41/08).

Delivery

Shipping costs (if any) are announced when ordering and are displayed on the page before concluding the purchase.

CSW reserves the right to make mistakes in the description and photo, as well as in the advertising display of the product. All customer rights to complaints and refunds are described in these terms.

Payment Methods

Ordered goods can be paid for:

  • By Credit/Debit card
  • By PayPal
  • By Direct Bank Transfer
  • By Cash On Delivery

The Credit/Debit Card payment system is integrated on the site. After selecting the “Credit/Debit Card” payment, it will open the fields for entering card data. Card and owner information is not stored on our servers.

The purchase was made after successful card authorization. If the system refuses to authorize card payments, choose one of the alternative payment methods. We have no information on the causes of card rejection, they can be of technical or business nature.

Invoice

We deliver the invoice for the order in the shipment together with the goods. We also send it to your email address.

Delivery

When we receive your order, we will hand over the ordered goods for delivery to the company with which we have a contract.

Countries We Deliver To

We deliver goods to the entire territory of the Republic of Croatia, except for areas that are not covered by roads or standard delivery services and methods of delivery of goods. We also send to the countries of the European Union, United Kingdom and Switzerland .

Delivery Cost

The shipping cost depends on the product you are buying. The total amount of the cart, as well as the country of delivery. The cost of delivery is neatly displayed on the website, as part of the Cart, before concluding the order

Delivery Time

We deliver all authorized orders to the delivery service within 48 hours at the latest. Authorized orders are those orders that the customer has confirmed by phone (applies to shipments that are paid upon collection), or orders that are paid before shipping (card, payment slip, internet copper…) Unfortunately, we are not able to influence further delivery speed and possible complications related to the delivery itself caused by the delivery service.

For each shipment, the recipient certifies and signs the delivery list upon receipt of the shipment. Pursuant to the provisions of the Civil Obligations Act, the certification of the delivery list by the consignee is considered that the consignment was delivered in undamaged condition and after that the carrier is released from any subsequent liability.

If the recipient does not exist at the specified address or the address is unknown, the delivery service will try to contact the recipient to agree on the exact time and possibly another delivery address. In case of impossibility of delivery, the shipment is returned to us. We undertake to deliver your order on time, if you have filled in your information completely accurately and truthfully, and no later than within the legally prescribed period of 30 days. If it is impossible to deliver the selected product, we are obliged to notify the customer in writing, and the customer has the right to cancel the order / contract or agree to a later delivery date. We will try to deliver all ordered items in one package. If this is not possible due to the stock, we reserve the right to deliver in several shipments.

Complaints

Complaints are recognized only with the presented invoice as the only proof of purchase. According to the Consumer Act, it is not possible to advertise a product that the customer has made according to his wishes (Article 79, paragraph 3 of the Consumer Protection Act).

Visible external damage to packaging or goods must be reported to the delivery service employee.

The right to a one-time termination of the contract

Only the Buyer who has concluded the Contract at a distance (Internet store) may terminate the contract without stating the reason for that (Article 72 of the Consumer Protection Act), within fourteen (14) days of receipt of the goods, assuming that he has previously received confirmation of previous notices. If the buyer with a distance contract has not received confirmation of prior notice of the possibility of unilateral termination of the contract, the right of the buyer to unilaterally terminate the contract is 12 months. Termination of the contract is possible for goods that have not been modified before production at the request of the customer (Article 79, paragraph 3 of the Consumer Protection Act).

In case he exercises his right, the buyer bears the cost of returning the goods and must return it within 14 days (Article 77 of the Consumer Protection Act). The buyer also bears the cost of any impairment of goods (Article 77 of the Consumer Protection Act) (unpacked goods, lost documentation and parts, damage, use of goods, etc.), except what was necessary to determine the nature, characteristics and functionality.

If the product is returned defective, with major damage or without parts and documentation and if it is not delivered within a later period of 8 days, it is considered that the Buyer has not fulfilled its obligation to return the goods and the Seller is not obliged to refund the funds in full. assessment of impairment of products.

Notice of the manner of written consumer complaint

All complaints in accordance with Article 10 of the Consumer Protection Act (N.N. 41/2014), you can send by mail or e-mail.

We must legally provide a response to your complaint in writing no later than 15 days from the date of receipt of the complaint. Otherwise, you can contact the State Inspectorate or the Consumer Protection Association.

If you accept the Terms of Use, you also accept the General Terms and Conditions as well as the Terms of Purchase.

CSW d.o.o. reserves the right to change these terms and conditions without prior notice. The business conditions are in accordance with the laws of the Republic of Croatia. In case of a possible dispute, the trader and the consumer will resolve the dispute amicably, and if it is not possible, the court has regular jurisdiction.
